When the actions of one driver, whether they were deliberate or accidental, result in the death of another, survivors of the deceased could be entitled to financial compensation. Personal injury law in Tennessee allows immediate family members to solicit financial reimbursement for burial costs, funeral expenses, lost income that the deceased would have earned during their lifetime, emotional trauma, loss of consortium, and loss of enjoyment of life.

In special circumstances, where the action that resulted in the death was malicious, egregious, or illegal, a civil court may also permit immediate family members to seek punitive damages against the respondent.
